HDR UK Futures

Welcome to HDR UK Futures, an online education platform that provides users with access to a wide range of health data science-related courses and educational materials (the “Site”) operated by Health Data Research UK (“HDR UK”).

HDR UK is a limited company registered in England and Wales under company number 10887014 and a charity registered with the Charity Commission under charity number 1194431 with its registered office at 215 Euston Road, London, England NE1 2BE.

Acceptance of Terms and Conditions of Use

By accessing or using the Site, you agree to be bound by these Terms and Conditions of Use (the “Terms”). If you do not agree to all of these Terms, you must not use the Site.

The following additional policies also apply to your use of the Site:

  • Privacy Policy, which sets out how we will use your personal data.
  • Cookie Policy, which sets out information about the cookies on our site.

Modification of the Terms

HDR UK reserves the right, at our discretion, to change, modify, add or remove portions of these Terms at any time. Changes will be communicated to you either via the Site or via email. Your continued use of the Site constitutes your acceptance of the changes to the Terms. If you do not agree to the changes, you must not continue to use the Site.

Account Registration and Security

To access certain features of the Site, you must register to create an account ("Account"). During the registration process, you will be required to provide certain information and you will establish a username and a password. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your login details. You must not disclose your Account login details to any third party and you take sole responsibility for any activities or actions under your Account. You will inform HDR UK promptly upon becoming aware of any actual or suspected unauthorised access to your Account.

HDR UK has the right to disable your Account at any time if, in our reasonable opinion, you have failed to comply with any of these Terms.

Access and Use of the Site

The Site is intended solely for users who are 18 years of age or older. Any access to or use of the Site by anyone under 18 is expressly prohibited.

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by HDR UK or its licensors.

Subject to these Terms, HDR UK grants you a non-transferable, non-exclusive right to access and use the Site for your personal and non-commercial purposes.

HDR UK reserves the right at any time and from time to time to modify, suspend, or discontinue temporarily or permanently the Site (or any part thereof) with or without notice. HDR UK will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Site.

Prohibited Uses

You must not take any action that imposes or may impose an unreasonable or disproportionately large load on the Site or its third-party providers’ infrastructure; interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or bypass any measures HDR UK may use to prevent or restrict access to the Site or parts thereof.

You must not misuse the Site by knowingly introducing any material that contains viruses, Trojan horses, worms, logic bombs, time-bombs, keystroke loggers, spyware, adware, or other harmful programs or material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which the Site is stored, or any server, computer, or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited behaviour includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our Site.

You must not reproduce, distribute, modify, disassemble, decompile, reverse engineer, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use.

You must not engage in any activity that would dishonestly improve your results or improve or hurt the results of other users in relation to any Courses.

Course Enrolment Access and Certificates

HDR UK Futures offers users the opportunity to enrol in online courses ("Courses"). Courses may have additional rules and policies which will be communicated via the Site. You agree to comply with all the rules and policies applicable to such Courses. You acknowledge that these rules and policies may change at any time.

Some Courses may be available for free while others may require payment of a fee. The fees for Courses that require payment will be set out on the Site. All fees are non-refundable and non-transferable except as expressly provided in these Terms.

Some courses may offer a certificate upon completion (“Certificate(s)”) subject to payment of a fee and successful completion of the course requirements. All fees paid for Certificates are non-refundable except as required under applicable consumer law. Prices for courses and Certificates are subject to change at any time but changes will not affect any order for a course or Certificate you have already placed.

User Content

The Site may allow you to upload, submit, store, or send content and data ("User Content"). You retain ownership of any intellectual property rights that you hold in the User Content. You warrant that you have the necessary rights, licences, consents, and/or permissions to reproduce and publish your User Content and that it will not infringe on any third-party rights.

You agree to give HDR UK (and our sub-licensees and sub-contractors) a non-exclusive, perpetual, transferable, assignable, worldwide, irrevocable license to use, host, store, modify, create derivative works (such as those resulting from translations, adaptations, or other changes we make so that your content works better with the Site), communicate, publish, perform, display, reproduce, and distribute and otherwise use such User Content in whole or in part in any form and in any media formats. The rights you grant in this license are for the limited purpose of operating, promoting, and improving the Site.

You are solely responsible for the User Content you upload, submit, or send on the Site. HDR UK reserves the right to block, remove, and/or permanently delete your User Content for any reason.

Termination

You agree that HDR UK, in its sole discretion, may suspend or terminate your Account or use of the Site and remove and discard any User Content within the Site for any reason, including without limitation for lack of use or if HDR UK believes that you have not complied with these Terms. Such suspension or termination may occur without prior notice although HDR UK will endeavour to provide notice where feasible. Upon termination, your right to use the Site will immediately cease.

Upon termination, HDR UK reserves the right to delete or archive your Account, including all related information and files in the Account, User Content, and/or prevent any further access to such files or the Site. HDR UK will not be liable to you or any third-party for any suspension or termination of your access to the Site nor for deletion of your data or User Content.

Payments Cancellations and Refunds

If you choose to enrol on a course with a fee, purchase a Certificate or any other paid service on the Site, you will be required to pay the fee indicated for that service. All fees are in Great British Pounds unless otherwise stated and are payable via Stripe or PayPal, our payment processing services. By making a payment, you agree to provide accurate and complete information for billing and confirm that you are authorized to use the payment method provided and agree to comply with the chosen payment processing service’s terms of use:

Refunds may be available for paid Courses and events under certain circumstances as detailed below:

  • For Courses where the Certificate has been purchased, a refund can be requested provided the Course has not been completed and the Certificate issued.
  • For webinars and other online events, presentations, or Courses, a refund can be requested up to 48 hours before the start of the event.
  • For any Courses or events that are in-person or include an in-person component, a refund can be requested up to 5 working days before the start of the event or Course.

Continuous Professional Development (CPD) Accreditation

Certain courses offered on the Site may be eligible for CPD points/credits. It is your responsibility to verify whether a course meets the CPD requirements of your professional body.

HDR UK makes no representation or warranty as to the recognition of its courses by any professional body for CPD purposes.

Third Party Terms

The Site has been created using the Open edX platform.

The Site may integrate with or contain links to third party applications, websites, and services ("Third-Party Service(s)") to make available content, products, and/or services to you. These Third-Party Services may have their own terms and conditions of use and privacy policies, and your use of these Third-Party Services will be governed by and subject to such terms and conditions and privacy policies. You understand and agree that HDR UK does not endorse and is not responsible or liable for the opinions, behaviour, features, or content of any Third-Party Service or for any transaction you may enter into with the provider of any such Third-Party Services, nor does HDR UK warrant the compatibility or continuing compatibility of the Third-Party Services with the Site.

External Resources

The Site may provide you with the ability to use and access resources such as articles, tools, and forums which are hosted or operated by third-party entities ("External Resources”). While HDR UK aims to provide access to high-quality and relevant resources, we do not control these external sites or services and are not responsible or liable for their content or accessibility. HDR UK does not endorse any views expressed by such External Resources and HDR UK makes no warranty or representation with respect to the completeness, security, reliability, quality, accuracy, fitness for purpose, or availability of such External Resources.

HDR UK is not liable for any issues arising from your use of any Third-Party Services and that your use of such Third-Party Services is at your own risk.

Disclaimer and Limitation of Liability

Your use of the Site, its contents, and any services or materials obtained through the Site is at your own risk. The Site, its contents, and any services or materials obtained through the Site are provided on an ‘as is’ and ‘as available’ basis without any warranties of any kind, either express or implied.

HDR UK makes no warranty or representation with respect to the completeness, security, reliability, quality, accuracy, fitness for purpose, or availability of the Site.

HDR UK, its licensors, service providers, employees, agents, officers, or directors will not be liable for claims, damages, or losses arising out of or in connection with your use or inability to use the Site, any External Resources linked to it, any content on the Site, or any Third-Party Services, including any direct, indirect, special, incidental, consequential, or punitive losses, claims, or damages, including but not limited to loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable, however, HDR UK does not limit or exclude liability for death or personal injury as a result of negligence, fraud, or statements made fraudulently or any other liability for which the governing law expressly prohibits limitation or exclusion.

Governing Law and Jurisdiction

These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by English Law. You agree to the exclusive jurisdiction of the courts of England.

Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
